1. Acceptance of Terms

By accessing or using the website www.theeventgallery.in or our mobile application ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please discontinue use immediately. These Terms constitute a legally binding agreement between you and TheEventGallery, Surat, Gujarat, India. The legal owner and operator of this Platform is BAJAJ DIVYA (trading as TheEventGallery).

2. Description of Services

TheEventGallery provides an AI-powered event photo sharing and management platform. Our services include:

• AI face-recognition powered photo delivery for event attendees.
• Event gallery creation and management for photographers and event hosts.
• Studio listing and discovery for photography businesses.
• AI-powered photo editing prompt generation.
• Digital invitations and WhatsApp sharing integrations.
• Subscription plans with payment processing via Razorpay.

3. User Accounts

• You must be at least 18 years old to create an account and use paid services.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You are solely responsible for all activities that occur under your account.
• Notify us immediately at hello@theeventgallery.in if you suspect unauthorized access.

4. Subscriptions and Payments

• Paid subscription plans are available for photographers and event hosts.
• Payments are processed securely via Razorpay. All prices are in Indian Rupees (INR) inclusive of applicable GST.
• Subscriptions renew automatically unless cancelled before the renewal date.
• We reserve the right to change pricing with 30 days' prior notice.
• Refer to our Cancellation & Refund Policy for details on refunds.

5. User Content and Licenses

"User Content" means any photos, videos, or other materials uploaded by you to the Platform.

• You retain full ownership of your User Content.
• By uploading, you grant TheEventGallery a limited, non-exclusive, royalty-free license to host, store, and display your content solely to provide the services.
• You represent that you have all necessary rights and permissions for any content you upload, including rights over identifiable persons in photos.
• We reserve the right to remove content that violates these Terms without prior notice.

6. Prohibited Conduct

You agree not to:

• Upload illegal, obscene, defamatory, or infringing content.
• Use the Platform to harass, stalk, or harm any individual.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Platform.
• Use automated tools (bots, scrapers) to access the Platform without our written consent.
• Misuse the face-recognition feature to identify individuals without their consent.
• Violate any applicable local, national, or international law or regulation.

7. Intellectual Property

All content, trademarks, logos, and software on the Platform (excluding User Content) are the exclusive property of TheEventGallery and are protected under Indian and international intellectual property laws. No part of the Platform may be reproduced, distributed, or transmitted without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, TheEventGallery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount paid by you to us in the 3 months preceding the claim.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. AI face recognition accuracy may vary and is provided on a best-effort basis.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, without prior notice. Upon termination, your right to use the Platform ceases immediately. Data deletion post-termination is governed by our Privacy Policy.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India. We encourage resolution through mutual discussion before initiating legal proceedings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
